Terms & Conditions

Welcome to Sharklady Adventures (“Sharklady”, “we”, “our”, or “us”). By making a booking through www.sharklady.co.za, by telephone, email, WhatsApp, or through any authorised booking partner, you acknowledge that you have read, understood and agree to these Terms & Conditions.

These Terms & Conditions govern all shark cage diving tours, marine wildlife tours and related services provided by Sharklady Adventures.

1. Bookings

All bookings are subject to availability.

A reservation is only confirmed once:

• your booking has been accepted by Sharklady Adventures; and
• full payment has been received.

We reserve the right to refuse any booking at our discretion where operational or safety requirements make it necessary.

When buying a voucher or receiving a voucher/offer to come back on the boat, the offer is 1 person for every person that booked and paid.

2. Payment

Full payment must be received before boarding the vessel.

Guests who have not settled their account in full before departure will not be permitted to board.

Prices displayed on our website include VAT unless otherwise stated.

Prices may change without prior notice; however, confirmed bookings will be honoured at the quoted price.

3. Cancellation Policy

We understand that travel plans sometimes change.

Guest Cancellation

• More than 24 hours before departure: Free cancellation with a full refund.
• Within 24 hours of departure: No refund will be issued.
• Failure to arrive for your scheduled tour (“no-show”) will be treated as a late cancellation and no refund will be payable.

Refunds are processed back to the original payment method where possible and may take several business days depending on your financial institution.

4. Weather Cancellation

Your safety is our highest priority.

If Sharklady Adventures CC cancels a tour due to:

• unsafe sea conditions;
• adverse weather;
• harbour closure;
• government restrictions;
• mechanical issues affecting safe operation; or
• any circumstance beyond our reasonable control,

you will receive a full refund of all monies paid, or you may choose to reschedule your booking (subject to availability).

The decision whether conditions are safe rests solely with the skipper and Sharklady Adventures.

5. Marine Wildlife Sightings

Sharklady Adventures operates in the natural marine environment.

Although our experienced crew enjoys exceptionally high sighting success, wildlife is free roaming and sightings cannot be guaranteed.

No refunds will be given if:

• sharks are not seen;
• weather conditions reduce visibility;
• wildlife behaviour changes; or
• particular species are absent.

Should the activity take place, but no sharks are seen, you will be issued a non-transferable voucher, valid for one year.

6. Departure Times

Launch times vary daily according to:

• tides;
• weather;
• harbour conditions; and
• operational requirements.

Your final check-in and departure time will be confirmed the day before your tour.

Guests must arrive at the designated meeting point at least one hour before launch. You will always be given the meeting time, not the launch time.

Late arrivals may miss the departure and will be treated as a no-show.

7. Medical Conditions

Guests should advise us before booking if they have any medical condition that may affect their participation, including but not limited to:

• heart conditions;
• epilepsy;
• severe asthma;
• neck or back injuries;
• recent surgery;
• pregnancy; or
• serious mobility limitations.

Participation remains entirely at your own risk.

If you are unsure whether the activity is suitable, please consult your medical practitioner before booking.

8. Fitness to Participate

The skipper reserves the right to refuse participation where a guest:

• appears intoxicated;
• is under the influence of drugs;
• behaves aggressively;
• poses a danger to themselves or others; or
• fails to follow crew instructions.

No refund will be payable in these circumstances.

9. Children

Children are welcome onboard.

Children participating in cage diving must meet our minimum participation requirements and must be accompanied by a responsible adult where required.

Parents or guardians remain responsible for minors at all times.

10. Safety

All guests agree to:

• follow instructions from the skipper and crew;
• wear safety equipment where instructed;
• behave responsibly at all times;
• avoid conduct that places others at risk.

Failure to comply may result in removal from the activity without refund.

11. Personal Property

Guests are responsible for their own personal belongings.

Sharklady Adventures CC accepts no responsibility for loss, theft or damage to:

• cameras;
• mobile phones;
• jewellery;
• clothing;
• luggage; or
• any other personal possessions.

Electronic equipment should be protected from seawater.

12. Photography & Media

During tours we may capture photographs and video for promotional purposes.

By participating, you grant Sharklady Adventures permission to use photographs or video in which you may appear for marketing, advertising, social media and website content.

If you do not wish to appear in promotional material, please notify our crew before departure.

13. Liability

Participation in marine activities involves inherent risks.

While Sharklady Adventures exercises the highest possible safety standards, participation is entirely voluntary.

To the maximum extent permitted by South African law, Sharklady Adventures CC, its owners, employees, crew members and contractors shall not be liable for:

• injury;
• illness;
• death;
• loss or damage to property;
• delays;
• missed travel connections;
• accommodation costs; or
• consequential or indirect losses arising from participation in our activities, except where caused by gross negligence or intentional misconduct.

Nothing in these Terms excludes any rights that cannot legally be excluded under the Consumer Protection Act 68 of 2008.

14. Force Majeure

Sharklady Adventures shall not be liable for cancellations or delays caused by events beyond our reasonable control, including but not limited to:

• severe weather;
• natural disasters;
• pandemics;
• government restrictions;
• harbour closures;
• labour disputes;
• civil unrest; or
• mechanical failures affecting safe operation.

Where possible, we will offer an alternative date or refund in accordance with these Terms.

15. Website Information

While every effort is made to ensure the accuracy of information on this website, Sharklady Adventures does not warrant that all content is complete, current or error-free.

We reserve the right to correct errors, update information and amend pricing without prior notice.

16. Intellectual Property

All content on www.sharklady.co.za, including but not limited to:

• text;
• photographs;
• videos;
• graphics;
• logos;
• website design;
• branding;
• downloadable material;
• layouts; and
• written content,

is the intellectual property of Sharklady Adventures and/or its licensors and is protected by South African and international copyright laws.

No material may be copied, reproduced, distributed, modified or republished without prior written permission.

17. Privacy

Personal information is collected and processed in accordance with our Privacy Policy and applicable South African privacy legislation, including the Protection of Personal Information Act (POPIA).

18. Governing Law

These Terms & Conditions shall be governed by the laws of the Republic of South Africa.

Any dispute arising from these Terms shall be subject to the jurisdiction of the South African courts.

19. Amendments

Sharklady Adventures CC reserves the right to amend these Terms & Conditions at any time.

The version published on www.sharklady.co.za shall apply to all new bookings from the date of publication.
